What types of rights are gays being deprived of by not being allowed to marry?
Q. Obviously, gays are deprived of many rights by not being allowed to marry. I was wondering what type of rights they were deprived of, such as medical, legal, etc. I know that joint medical decisions and visitation rights are limited to immediate family. If there is a gay couple, and one of them is in the hospital, his or her partner would nto be considered immediate family and would therefore not be able to have visitation rights or help make decisions. What other rights like these are gays deprived of?

A. Well here is a site that tells about all the rights and benefits of marriage (3 Pages, I separated them for you; from same site): Page 1; Tax Benefits, Estate Planning Benefits, and Government Benefits: Page 2; Employment Benefits, Death Benefis, Family Benefits, Housing Benefits, Consumer Benefits: Page 3; Other Legal Rights & Benefits: Legal marriage is different from religious marriage and people confuse the 2. People think marriage is where you stand side by side on an alter, make wedding vows and exchange rings. That is the religious marriage. But the legal marriage is simply a contract that grants the couple a collection of rights and benefits, some VERY important. The above link shows the rights and benefits of LEGAL… [cont.]

A. A. You have certain rights the govt. may not violate. But OTOH you also have certain responsibilities of citizenship, an those rights hinge on your responsibilities.

Where does the Constitution give rights to foreign citizens?
Q. I cannot find anywhere in the Constitution or the Bill of Rights that a foreign citizen is mentioned as having rights under these documents, specifically prisoners of war. Article I, Section 8 does give Congress the power to "make rules concerning captures on land and water," but that's about as close as it gets.

A. It is illegal under our constitution to torture people. Hauling them off to a foreign land does not allow the govt to abdicate their responsibilities and obligations. In addition we signed the Geneva Convention and that also forbids such actions. Our country has always set standards for the world to follow. Bush and Cheney have lowered our standards so much the whole world hates us now and millions are willing to die to kill some of us. They have also taken native born American citizens to Gitmo for their torture. I say waterboard Bush, Cheney and anyone who agrees with their torture. You do know that eventually the person being tortured will say anything his captors want him to say whether true or not, don't you?

  • People are usually surprised to discover that I hate the phrase "constitutional rights." I hate the phrase because it is terribly misleading. Most of the people who say it or hear it have the impression that the Constitution "grants" them their rights. Nothing could be further from the truth. Strictly speaking it is the Bill of Rights that enumerates our rights, but none of our founding documents bestow anything on you at all [...] The government can burn the Constitution and shred the Bill of Rights, but those actions wouldn't have the slightest effect on the rights you've always had.
